Introduction
The following current terms and conditions (“General Terms and Conditions”) apply to all prize draws and competitions (“the Promotions”) promoted by the Promoter.
Details of the Promoter are set out at the end of these General Terms and Conditions. For transparency the Promoter is Pioneer Business Development Solutions (BDS) t/a Pioneer Competitions. Pioneer BDS is is a private limited company organized under the laws of England and Wales.
Promotions are run to raise funds for a nominated beneficiary. Manchester Storm is the nominated beneficiary for the Manchester Storm Prize Draw and will be referred to as ‘The Beneficiary’ hereafter. All proceeds are donated to Manchester Storm for their youth and community development activities. INSERT TARGET PERCENTAGE???
To enter or win the Manchester Storm Prize Draw and all other Pioneer Competition Prize Draws, no purchase, payment, or donation of any kind is necessary. All entries into the Manchester Storm Prize Draw and all other Pioneer Competition Prize Draws have an equal chance of winning.
These General Terms and Conditions include conditions of any of the Promotions which may be mentioned at the “point of interaction” (being the place, time, site, media, leaflet or other promotional material or any other platform where an entrant is seeking and or receiving any information about any of the Promotions and/or uses the point of interaction to enter any of the Promotions.
These specific terms and conditions of any of the Promotions shall be known as the “Interaction Information”. Such information includes, but is not limited, to method of entry, age restrictions, deadlines and information required. You will find all such relevant information at the main point of interaction which is www.manchesterstormprizedraw.co.uk. Interaction is considered to take place between an entrant and the Promoter or the Promoter’s representative in any or during the promotion of, or messages about, any of the Promotions on any platform or by any means or at the time when the entrant carries out the necessary actions and/or provides information in order to enter any of the Promotions.
Please read these General Terms and Conditions and appropriate Interaction Information carefully. If you do not agree with any of the Terms and Conditions and associated Interaction Information then you should not take part in any of the Promotions as may be applicable.
The General Terms and Conditions may be amended at any time without prior notice. Any changes will be posted on the Pioneer Competition and Manchester Storm Prize Draw websites. It is your responsibility to ensure you review the current Terms and Conditions before entering any of the Promotions.
A hard copy is available on request in writing to the Promoter. Such request must be made to the address below and accompanied by a stamped self-addressed DL envelope. In addition if you want this information electronically then please email info@pioneercompetitions.co.uk or info@pioneerbds.com.
It is recommended that you print and store or save a copy of these current General Terms and Conditions for future reference during the Promotions.
1 Eligibility
• Entrants must meet the eligibility requirements as specified in the Interaction Terms and Conditions. Failure to meet the eligibility requirements will result in an entry being invalid and/or forfeiture of any prize.
• Promotions are open to residents of the United Kingdom (UK being England, Scotland, Wales and Northern Ireland), Isle of Man and Channel Islands aged 18 years or over at the time of entering any of the Promotions unless specified otherwise. Proof of this must be provided to access any prize.
• If selected as a winner of one of the Promotions, the winner must provide a UK, Isle of Man or Channel Islands address. The Promoter will not award prizes to anyone registered at an address outside the UK. Isle of Man or the Channel Islands.
• Employees and members of their immediate families (including any live-in Partner) of the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize, are ineligible to enter. Any such entries are invalid.
• The Promoter reserves the right in its sole discretion to ask for evidence to verify the age, address, identity and / or eligibility of an entrant at any time and to use any channels and methods available to carry out checks of any details provided. The Promoter may withhold delivery of a prize until it has received such evidence from the winner and failure to provide such evidence in a timely manner may result in forfeiture of the prize.
2 Entry
2.1 Entrants agree that by entering any of the Promotions their personal details may be stored and otherwise processed by the Promoter that the Promoter may contract with for the purposes of administering this Promotion and all future Promotions for marketing and the sending of offers and other information.
2.2 Entrants agree that by entering any of the Promotions they accept the General Terms and Conditions and agree to abide by them. Entrants accept that any decision of the Promoter will be final.
2.3 All entries into any of the Promotions must be entered between the opening and closing dates and times.
2.4 The opening and closing date and time for entries into the Promotions are as indicated in the Interaction Information. Any entries received before the opening date and time may count towards any applicable cap on entries specified in the Interaction Information.
2.5 Entries received after the closing date and time of any Promotions will not be considered.
2.6 In respect of prize draws, entrants simply need to submit the required information as indicated on the official website.
2.7 Entrants may be required to provide their full name, full contact telephone number (Including area code) or other method of contact (if applicable), email address and any other information as specified at the time of entering any of the Promotions. Such information must be correct and accurate and cannot be amended once an entrant has entered any of the Promotions. Failure to provide such information may disqualify entry into one or more of the Promotions.
2.8 Each entrant may be charged a cost of entry (if any) to one or more of the Promotions as indicated in the Interaction Information whether such entry to any of the Promotion is successful or not. If applicable, entrants must have the permission of the bill payer before entering the Promotions. Any cost of entry and any entry delivery costs as indicated in these General Terms and Conditions or in the Interaction Information includes taxes.
2.9 The Promoter cannot guarantee that entries submitted by eligible residents of the UK, Isle of Man and the Channel Islands from outside the UK, Isle of Man and Channel Islands will be entered into any of the Promotions and charges will depend on the relevant service provider’s international rates. The Promoter gives no warranty that any relevant service will be available, legal or appropriate for use in locations outside the UK.
2.10 Entry to the Promotions must be by the applicable method(s) as indicated in the Interaction Information which may include any (but not necessarily all) of the following:
2.10.1 Postal entry: One postal entry = one entry maximum. Postal entrants may enter relevant Promotions by mailing their full name, Email address and/or a contact telephone number (including area code), as well as other required information and/or material to the postal address as specified in the Interaction Information. It is recommended that where entrants are required to submit a contribution that they send in copies rather than original material as such material will not be returned unless otherwise specified in the Interaction Information. Entries sent by post must be received at the relevant postal address specified for entries by the closing date and time for receipt of entries. In the case of multiple entries received in a single communication, envelope or on a single postcard, only one entry will be entered into the particular promotion. It is the responsibility of the postal entrant to ensure correct and sufficient postage is paid. Postal entries without correct and sufficient postage paid will be invalid and will not be considered. Unless otherwise specified, personal and hand deliveries will not be accepted. The Promoter does not accept responsibility for any incorrectly addressed or undelivered entries or for any disruption, delay or misdirection of postal entries.
2.10.2 Online: Multiple entries can be purchased in bulk by the official promotion website of www.manchesterstormprizedraw.co.uk
2.11 Entries must not be sent in through agents, third parties or on behalf of another person unless otherwise specified in the Interaction Information. Such entries are void. Bulk entries are void and cannot be accepted.
2.12 Any entries made which are above the maximum number of entries for each method of entry as specified in the Interaction Information or which are incomplete, without all the required information, inaudible, incomprehensible, made or received after the deadline for receiving entries has passed or which are not received by the Promoter or are not otherwise in accordance with the Interaction Terms and Conditions are invalid and will be discounted.
2.13 Automated entries are not permitted and will be invalidated.
2.14 Multiple entries by the same person made under different or assumed names are not permitted and will be invalidated.
2.15 Any entry which is false or deceptive is invalid.
2.16 The use of any device whether electronic or otherwise to enhance or alter the odds of any entry winning a prize is not permitted and each resulting entry will count as a deceptive entry and will be invalid.
2.17 The Promoter is under no obligation to publicise or not to publicise any or all invalid or otherwise disqualified or voided entries. Any such publicity undertaken shall be at the sole discretion of the Promoter.
2.18 In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of any answers given by entrants, or the operation of any part of the promotion, network or phone system, the decision of the Promoter shall be final.
3 Prizes
3.1 Prizes are as specified in the Interaction Information. Unless otherwise stated in the Interaction Information only one prize per entrant (ie per person entering) per promotion is permissible. Such prize shall be the first prize won sequentially by the entrant. Any subsequent prizes shall be discounted for that entrant and left available for other entrants to win.
3.2 Any images of prizes in any Interaction Information or used elsewhere are for illustrative purposes only and may not relate accurately to the actual prizes or any substitute or alternative provided.
3.3 No responsibility for any loss or damage whatsoever is accepted by the Promoter where such loss or damage is caused by any inaccurate prize details.
3.4 Prizes are subject to availability and to winner confirmation, i.e. the Promoter has managed to contact the winner and received confirmation of eligibility. Prizes are also subject to the terms and conditions of the prize provider, their agents, and where applicable to the terms of the venue and/or the manufacturer
3.5 Prizes are only available to winners who have completely and wholly complied with the Interaction Terms and Conditions
3.6 Where a prize includes ‘cash’ as described on the Interaction Information then such cash shall be paid in the form of a cheque payable in pounds sterling in the name of the winning entrant only and cannot be made payable to any third party. No other form of payment will be considered.
3.7 The Promoter reserves the right to withhold any prize where it has sufficient reason to believe that the winning entry may have been subject of dishonesty, fraud, manipulation, tampering, was spoilt, voided, forfeited or was not entered in accordance with the Interaction Terms and Conditions.
3.8 Prize winners must comply with the Promoter’s instructions relating to the claiming, collection or delivery of the prize. Failure to comply with such instructions may lead to the forfeiture of the prize.
3.9 Where the prize and/or information relating to the prize is to be provided directly to the winner by a third party, the winner (and where applicable, their companion(s)) is (are) required to comply with all instructions and necessary requirements as may be specified by the third party to receive and/or take up the prize, including but not limited to contacting such third party within specified time frames, adhering to the itinerary as specified, paying any required charges and/or costs which are not included in the prize, completing any required documentation to that third party, including but not limited to proof of identification. The Promoter will accept no responsibility and will not be liable to the winner or any other persons where the winner fails to comply with such instructions and such failure may result in forfeiture of the prize.
3.10 The winner (and where applicable, their companion(s)) may be required to provide their signature as proof of their agreement to relevant waivers, releases and/or consents when taking up the prize. Failure to sign any relevant documentation may result in forfeiture of the prize. The prize excludes all other costs and arrangements not expressly included in the prize (as stated in the Interaction Information). Additional charges and expenses incurred, services, facilities, not expressly included in the prize are payable solely by the winner (and where applicable their companion(s)). The Promoter will not be held liable where such charges and/or expenses are incurred, and no refund or reimbursement will be made. The Promoter will accept no responsibility where the winner is unable to pay in full, any such charges and/or expenses as incurred.
3.11 For some Promotions, winners may need to commit to receiving the prize at a place and time set out in the Interaction Information. Failure to attend the specified time and place will lead to forfeiture of the prize.
3.12 No cash equivalent (where applicable) or alternative prize will be given at the request of the winner and all prizes are non-transferable and non-exchangeable. However, the Promoter reserves the right to change any prize or any part of a prize (to an alternative prize or part of the prize of equal or greater value) for any reason in its sole discretion including without limitation due to circumstances beyond its control or if any part of the prize becomes unavailable. If for any reason the winner chooses not to take any prize or any part of a prize the Promoter reserves the right to require the winner to confirm this in writing and the Promoter will be able to retain or dispose of the prize at its own discretion.
3.13 The Promoter may refuse to provide a prize, or seek its recovery, in the event of non entitlement under the interaction terms and conditions or any entrant’s breach of the interaction terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade applicable charges when entering the promotion.
3.14 No responsibility is accepted by the Promoter if any prize is damaged, lost or stolen after delivery to or acceptance by the winner. No replacement shall be provided by the Promoter under any circumstances.
3.15 Where applicable in some Promotions and as described in particular Interaction Information, winners must claim prizes within the specified period without fail. Failure to claim any prize with the specified period will lead to forfeiture of the prize.
3.16 The Promoter reserves the right to offer a cash prize alternative, should not enough paid entries be received so as to cover the cost of the original prize.
4 Winner Selection
4.1 Where the winner is randomly selected, the draw for the winner will take place on the date indicated in the Interaction Information. Unless stated otherwise in the Interaction Information, the winner will be the first entry drawn at random from all valid entries, subject to eligibility and winner confirmation (and, for competitions where entrants are required to answer a question, answering such question correctly). Where the winner is not randomly selected, the Interaction Information will detail the judging criteria on which the winning entry will be selected.
4.2. You have to be 18+ at the time of purchase to enter into this Promotion. The Promoter will authenticate this before the prize is awarded.
4.3. Should the prize winner be found to not be of age (as point 4.2) then the Promoter reserves the right to redraw the participants to find a new winner. The Promoter reserves the right to disqualify any such entrant (without further liability to that entrant) and offer the prize to the next eligible entrant and thereafter until a suitable winner is found.
5 Winners Notification
5.1 Winner names and locations will be listed on the ‘winners’ page of the relevant website following a draw taking place. Where applicable winner names may also be mentioned in relevant publicity programmes using any form of media that the Promoter wishes to use at its sole discretion including but not limited to local and national press, TV and social media. This means that if you are a winner your name and location will at least be published at www.dreamlivingdraw.co.uk and may be announced in any Pioneer Competions and Manchester Storm relevant publicity programme and/or used within any media as described above.
5.2 If you do not wish to have your name and location published then do not enter any of the Promotions.
6 Winner Contact
6.1 General contact: The winner will be contacted as soon as practicable on or after the draw date or judging date (as appropriate) as indicated in the Interaction Information. Reasonable efforts will be made to contact a winner on the phone number provided when entering the Promotions or such other method of contact deemed appropriate by the Promoter at its sole discretion in the circumstances.
Unless the prize is time critical or time sensitive, the Promoter will try to contact the winner over a 2 week period following the draw.
6.2 Time critical: Where the prize must be taken up within 3 months of the close date of the Promotions, the Promotions will be considered “time critical”. As a winner needs to be found before the time to take up the prize passes, the Interaction Information will indicate the date (s) and or period when the winner will be contacted. The Promoter will attempt to contact such winner on the phone number (or other method or contact (if appropriate)) they provided, calling three times in a three-hour daytime period or as indicated in the Interaction Information.
6.3 Time sensitive: Where the prize must be taken up by a date which is more than 3 months but less than 12 months after the close date of a promotion, unless otherwise stated in the Interaction Information the Promoter will contact the winner on the phone number (or other method of contact (if appropriate) they provided calling at different times on weekdays and at least once at the weekend over a two week period following the draw or as indicated in the Interaction Information.
6.4 In the event that the winner cannot be contacted or successful contact is not made within the time period set out in clauses 6.1 to 6.3 above (as applicable) or if the winner fails to provide an address for delivery of the prize or fails to meet any of the eligibility requirements or is otherwise unable to comply with the Interaction Terms and Conditions, this may result in forfeiture of the prize and the Promoter reserves the right to disqualify that entrant (without further liability to that entrant) and offer the prize to the next eligible entrant and thereafter until a winner is found.
7 Winner Publicity
7.1 The winners of Promotions may be required to participate in publicity. The Promoter (or any third party nominated by the Promoter) may exercise its sole discretion to use the winner (and if applicable their companions’) names and images and their personal comments relating to the prize and promotion experience for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.
7.2 If you do not wish to have your name and location published then do not enter any of the Promotions.
8 Manipulation
8.1 The Promoter is committed to operating its Promotions fairly and to preventing as far is practicable any abuse of its processes, systems or services related to its Promotions as well as those of its agents and sub-contractors.
8.2 For this reason the Promoter reserves the right to disqualify and/or discount entries if it has reasonable grounds to suspect, at its sole discretion, having regard to all the circumstances and information available at the time, any of the following:
8.2.1 Activity has occurred that is designed to excessively manipulate the systems or processes or odds of the Promotions or
8.2.2 Entries have been made in breach of the General Terms and Conditions or
8.2.3 There has been any activity which the Promoter considers is designed to unfairly influence the outcome of any of the Promotions and/or provide an unfair advantage to the entrant including without limitation use of automated or semi-automated calling technology (such as auto-diallers) or other automated technology; or the making or disguising of multiple entries or votes by an individual entrant using multiple different phone numbers (or other details on which limits on number of entries or votes are based).
8.2.4 If the Promoter has reason to believe that an individual entrant of its Promotions has made more than the maximum allowable number of entries per entrant (ie: per person) as set out in the Interaction Information using different phone numbers (or other details on which limits on number of entries are based) from any one entry platform then the Promoter will treat this as an attempt to unfairly influence the Promotions and all entries submitted by that entrant will be discounted.
8.2.5 If the Promoter determines that an individual has attempted to unfairly influence or manipulate any of the Promotions then in addition to disqualification and/or discounting entries, it may (at its sole discretion) ban that individual from future Promotions and disqualify and/or discount any future entries by the entrant in respect of its Promotions.
9 Liability
In relation to all the Promotions promoted by the Promoter:
9.1 Nothing in the General Terms and Conditions restricts your statutory rights as a consumer. For more details on these statutory rights you should contact Local Trading Standards Office or Citizen’s Advice Bureau.
9.2 Nothing in the General Terms and Conditions shall exclude or limit the Promoter’s liability for death or personal injury caused by their staff or suppliers’ negligence or for fraud or for any other liability which cannot be limited or excluded by law or regulation.
9.3 Subject to 9.1 and 9.2, the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or a prize do not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by you as an entrant or participant howsoever arising from participating in the Promotions or from accepting any prize whether due to any error, omission or other cause by the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or a prize, agents or others or by any other cause.
9.4 Subject to 9.1 and 9.2 the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and /or a prize are responsible for any damage or loss caused to you (i) which is not reasonably foreseeable to you and to the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with this promotion, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or a prize when you agree to the terms and conditions (which occurs automatically when you enter a competition, prize draw or (ii) is reasonably foreseeable to you and to the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or a prize when you agree to the Interaction Terms and Conditions but is only indirectly related to you entering or participating in the Promotions.
9.5 Subject to 9.1 and 9.2, the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize can promise that the services relating the Promotions will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond the control of the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize.
9.6 Subject to 9.1 and 9.2, the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize will be liable to you or to any other person in the event that any entry, lost, delayed or not properly received, registered or recorded or where all or any part of the service relating to the Promotions is discontinued, modified or changed in any way.
9.7 You agree to reimburse the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize in respect of any damages suffered by the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize or any losses by the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize resulting from any claim made by a third party in each case in respect of any matter arising from your use of the services relating to the Promotions in breach of the Interaction Terms and Conditions or from your violation of any applicable law or regulation.
9.8 Subject to 9.1 and 9.2, the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with this promotion, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize will not be liable to reimburse the cost or expenses incurred in making a Promotions entry.
9.9 Subject to 9.1 and 9.2 the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with this promotion, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize where applicable do not accept responsibility for any incorrectly addressed or undelivered competition or prize draw entries, or for any disruption, delay or misdirection of such entries.
10 Privacy
10.1 Information and data (“personal data”) which is provided by you when you enter any of the Promotions, will be held by the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions and may be used by the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize and their service providers, network operators, suppliers and contractors for the purposes of administering and fulfilling the Promotions and in connection with any costs associated with entry to the Promotions. You agree that this includes without limitation that the Promoter may contact you if there is an issue with the Promotions or your interaction with the Promotions.
10.2 Any personal data will be used in accordance with the Pioneer BDS privacy policy and you agree to this use when you participate in any of the Promotions. 10.3 The Promoter and/or the prize provider may be required to send personal data of the winner of a promotion (and where applicable, their companion(s)) to third parties outside the European Economic Area, for the purposes of fulfilling and administering the promotion and/or the prize and the promotion winner agrees to such transfer for these purposed.
10.4 The winners name and location may be publicised as a means of general winners’ notifications within the public domain. Please refer to clause 5 “Winner Notification” above.
10.5 The winner of any Promotion may also be required to participate in publicity. Please refer to clause 7 “Winner Publicity” above.
10.6 Telephone calls carried out between you and the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize and their service providers, network operators, suppliers and contractors may be recorded for quality control purposes and staff training.
11 General
11.1 Please note that when you pay for a Promotions entry, any rights you may have to withdraw from or cancel your payment (including but not limited to under the Consumer Protection (Distance Selling) Regulations 2000 and the Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013) will be lost because the performance of the Promotions is simultaneous or begins immediately once your purchase is completed.
11.2 You agree that you do not have any commercial relationship with the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the promotion and/or prize, and that you are not an agent or an employee or member of an employee’s immediate family (including any live-in Partner) of the Promoter, companies within the Pioneer BDS group of companies and any of their subsidiaries and/or agencies associated with the Promotions, including the provider of the prize, or any person connected with the administration or otherwise of the Promotions and/or prize.
11.3 The Interaction Terms and Conditions are available in English only and shall be exclusively governed by and construed in accordance with the laws of England unless the entrant to the Promotions is a Scottish or Northern Irish resident in which case he/she may choose the law of their residence and they irrevocably submit to the exclusive jurisdiction of the courts of England and Wales again unless the entrant is a Scottish or Northern Irish resident in which case they may choose the courts of their residence in Scotland or Northern Ireland.
